When an ESA Letter Won't Work

A few situations where an ESA Letter doesn’t need to be accepted:

  • No public-access rights. ESAs aren’t covered under the ADA, so stores, restaurants, and other public businesses can still say no.
  • Pet fees on some airlines. Since the 2021 DOT rule, airlines can treat ESAs as pets and charge standard pet fees.
  • Owner-occupied small buildings. Fair Housing Act exemptions can apply to owner-occupied buildings with 4 or fewer units.
  • No-vacancy situations. A landlord isn’t required to make an exception if there’s genuinely no unit available.
